1. Acceptance of Terms
By accessing or using eastportemerald.com ("the Site") and completing a booking, you ("the Guest") agree to be bound by these Terms of Service, the Rental Agreement, House Rules, Cancellation Policy, and Privacy Policy. If you do not agree, do not use this Site or make a reservation.
2. About Us
This Site is operated by Runabell Holdings LLC, a Florida limited liability company, for the purpose of facilitating direct bookings at Eastport Emerald Escape, located at 1979 Hilfiker Avenue, The Villages, FL 34762.
3. Eligibility
- You must be at least 21 years of age to make a reservation.
- The person making the booking must be one of the guests staying at the property.
- You represent that all information provided during booking is accurate and complete.
4. Booking & Payment
- All reservations are subject to availability.
- A booking is confirmed only upon successful payment (instant booking) or host approval followed by payment (request-to-book mode).
- Prices displayed include nightly rate, applicable discounts, pet fees, and all taxes. No hidden fees.
- Payment is processed securely via Stripe. We do not store your credit card information.
- By completing payment, you authorize Runabell Holdings LLC to charge the total amount shown at checkout.
5. Rental Agreement & House Rules
All bookings are governed by the Short-Term Vacation Rental Agreement. By completing a reservation, you agree to the full Rental Agreement and House Rules, which include but are not limited to:
- Check-in: 3:00 PM | Check-out: 11:00 AM
- Maximum 4 overnight guests
- No smoking inside the property
- No parties or events
- Quiet hours: 10 PM – 8 AM
- Pets: up to 2 small dogs (20 lbs max), $75/pet/stay
6. Cancellations & Refunds
Cancellations are governed by our Cancellation Policy (Firm). Full refund 30+ days before check-in, 50% refund 7–30 days, no refund under 7 days. Non-refundable bookings are not eligible for any refund.
7. Guest Responsibilities
- Comply with all terms of the Rental Agreement and House Rules
- Treat the property with reasonable care
- Report any damage or issues promptly
- Ensure all guests and visitors comply with these terms
- Pay for any damages beyond normal wear and tear
8. Limitation of Liability
Runabell Holdings LLC provides the property "as is." To the maximum extent permitted by law:
- We are not liable for personal injury, property loss, or damage during your stay, except where caused by our gross negligence.
- We are not liable for interruptions to utilities, internet, community amenities, or other services outside our control.
- Our total liability for any claim shall not exceed the total amount paid for the reservation.
9. Intellectual Property
All content on this Site — including text, photographs, graphics, logos, and design — is owned by Runabell Holdings LLC and protected by copyright law. You may not reproduce, distribute, or use any content from this Site without written permission.
10. User Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Site
- Submit false or misleading information
- Interfere with the proper functioning of the Site
- Scrape, data-mine, or automatically collect information from the Site
11. Third-Party Services
The Site uses third-party services for payment processing (Stripe), analytics, and communication. Your use of these services is subject to their respective terms and privacy policies. Runabell Holdings LLC is not responsible for third-party service outages or issues.
12. Modifications to Terms
We reserve the right to update these Terms of Service at any time. Changes take effect when posted to this page. The "last updated" date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised terms. Bookings are governed by the terms in effect at the time of booking.
13. Governing Law & Disputes
These terms are governed by the laws of the State of Florida. Any disputes shall be resolved through binding arbitration in Sumter County, Florida, under the rules of the American Arbitration Association. The prevailing party is entitled to recover reasonable attorney's fees.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
