Short-Term Vacation Rental Agreement

This Short-Term Vacation Rental Agreement ("Agreement") is entered into between Runabell Holdings LLC ("Owner/Manager") and the guest ("Guest") who completes a booking through eastportemerald.com or any affiliated booking platform. By completing a reservation, the Guest acknowledges and agrees to the terms set forth in this Agreement.

1. Property

The property subject to this Agreement is located at:

1979 Hilfiker Avenue, The Villages, FL 34762

The property is a 2-bedroom, 2-bathroom single-family home in a 55+ active adult community. The entire home is available to the Guest for the duration of the reservation, including all furnishings, appliances, and amenities as described on the property listing.

2. Reservation & Payment

  • Booking confirmation: A reservation is confirmed only upon receipt of full payment or, in request-to-book mode, upon host approval and subsequent payment.
  • Payment: Full payment is collected at the time of booking via Stripe (credit/debit card). All rates are quoted in US Dollars (USD).
  • Pricing: The total cost includes the nightly accommodation rate, applicable discounts, pet fees (if applicable), and Florida state and county taxes.
  • Taxes: Florida Sales Tax (6%) and Sumter County Tourist Development Tax (1%) are collected and remitted by the Owner/Manager.
  • No hidden fees: The price shown at checkout is the total price. There are no additional service fees, cleaning fees, or platform fees when booking direct.

3. Check-In & Check-Out

  • Check-in: 3:00 PM or later
  • Check-out: 11:00 AM or earlier
  • Access: Self check-in via smart lock. A unique door code will be provided to the Guest via email within 24 hours of arrival.
  • Early/Late requests: Early check-in or late check-out may be accommodated at the Owner's discretion and subject to availability. Additional charges may apply.
  • Failure to check out on time may result in a charge of one additional night at the current nightly rate.

4. Occupancy

  • Maximum overnight occupancy: 4 guests (as listed on the reservation)
  • Only guests listed on the reservation may stay overnight.
  • Maximum daytime occupancy (including visitors): 8 persons
  • The Guest is responsible for the behavior of all occupants and visitors.

5. House Rules

The Guest agrees to abide by the House Rules, which are incorporated into this Agreement by reference. Key rules include but are not limited to:

  • No smoking or vaping inside the property
  • No parties or events
  • Quiet hours: 10:00 PM – 8:00 AM
  • Pets: up to 2 small dogs (20 lbs max each), $75 per pet per stay
  • No street parking overnight

6. Cancellation & Refunds

This rental is subject to the Cancellation Policy (Firm), summarized below:

  • 30+ days before check-in: Full refund
  • 7–30 days before check-in: 50% refund
  • Less than 7 days: No refund
  • Non-refundable rate: If selected at booking, no refund is available regardless of cancellation timing

Refund requests must be submitted via email to bookings@runabellholdings.com. Refunds are processed within 5–10 business days to the original payment method.

7. Property Care & Damages

  • The Guest agrees to treat the property with reasonable care and leave it in substantially the same condition as found.
  • The Guest shall report any damage, malfunction, or maintenance issue promptly to the Owner/Manager.
  • The Guest is financially responsible for any damage to the property, furnishings, appliances, or fixtures beyond normal wear and tear.
  • A $250 cleaning surcharge will be assessed if the property requires excessive cleaning (evidence of smoking, pet damage not cleaned up, unreasonable mess, etc.).
  • Repair or replacement costs for damaged items will be assessed at fair market value and charged to the Guest's payment method on file.

8. Liability & Assumption of Risk

Guest acknowledges and agrees to assume all risks associated with the use of the property located at 1979 Hilfiker Avenue, The Villages, FL 34762. Guest releases Runabell Holdings LLC from any liability for injuries, damages, or losses except in cases of gross negligence.

  • The Guest assumes all risk associated with the use of the property, including but not limited to swimming pools, recreation areas, and community amenities.
  • Runabell Holdings LLC shall not be liable for any personal injury, death, property damage, or theft occurring during the Guest's stay, except where caused by the Owner's gross negligence or willful misconduct.
  • The Guest is encouraged to obtain travel insurance to cover trip cancellation, medical emergencies, and personal property loss.
  • The Owner/Manager is not responsible for interruptions to utility services (electric, water, internet) or community amenities caused by third parties.

8a. Pet Liability Addendum

Guest assumes full responsibility for any pet-related damages or injuries occurring during the stay and agrees to indemnify the Owner. This includes but is not limited to damage to floors, furniture, landscaping, or injury to other persons or animals. Pets must be disclosed at booking and are subject to the pet fee ($75 per pet per stay, maximum 2 small dogs, 20 lbs max each).

8b. Golf Cart Disclaimer

The Owner does not provide a golf cart. The Villages is a golf-cart-friendly community, and rental carts are widely available from local vendors. Any use of rented golf carts is at the Guest's own risk. The Owner assumes no liability for injuries, accidents, or damages arising from the Guest's use of a golf cart during their stay.

9. Indemnification

The Guest agrees to indemnify, defend, and hold harmless Runabell Holdings LLC, its owners, managers, agents, and affiliates from all claims, damages, liabilities, costs, or legal fees arising from:

  • The Guest's use of the property
  • Violation of this Agreement or the House Rules
  • Injury to or death of any person at the property during the Guest's stay
  • Damage to the property or any third-party property
  • Pet-related damages or injuries
  • Golf cart or vehicle incidents

10. Early Termination

The Owner/Manager reserves the right to terminate the Guest's stay immediately and without refund if:

  • The Guest violates this Agreement or the House Rules
  • The Guest engages in illegal activity on the property
  • The Guest causes or threatens to cause damage to the property
  • The Guest disturbs neighbors or community residents
  • Occupancy exceeds the registered number of guests

11. Force Majeure

Neither party shall be liable for failure to perform obligations under this Agreement due to circumstances beyond their reasonable control, including but not limited to natural disasters, pandemics, government orders, severe weather, or acts of war. In such cases, the Owner/Manager will work with the Guest in good faith to reschedule the stay or provide a refund, at the Owner's discretion.

12. Privacy

Guest information is collected and used in accordance with our Privacy Policy. The Owner/Manager will not share Guest personal information with third parties except as necessary to fulfill the reservation (payment processing, tax reporting, and communication about the stay).

13. Disputes & Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
  • Any disputes arising from this Agreement shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Sumter County, Florida, under the rules of the American Arbitration Association.
  • The prevailing party in any dispute shall be entitled to recover reasonable attorney's fees and costs.

14. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

This Agreement, together with the House Rules, Cancellation Policy, Terms of Service, and Privacy Policy, constitutes the entire agreement between the Owner/Manager and the Guest. No verbal or written modifications shall be effective unless agreed to by both parties in writing.

16. Acceptance

By completing a booking on eastportemerald.com, the Guest acknowledges that they have read, understood, and agree to be bound by this Agreement and all referenced policies. The act of completing the booking constitutes the Guest's electronic signature and acceptance of these terms.
